Courtroom dynamics have changed over the decades. Today’s jury pool is comprised of multiple generations of film, television, and internet legal “experts”. The thoughtfulness and polite courtroom presentation of Atticus Finch of “To Kill a Mockingbird” has been obliterated by years of “Perry Mason”, “Boston Legal”, five incarnations of “Law & Order” and four “CSI” series. Juries now have high expectations of being presented, if not entertained, by compelling, advanced, and highly detailed trial exhibits; often with the attorney delivering the highest production value receiving the favorable verdict. Often a case is won or lost before the opening statement, the direct result of one side preparing by practicing before a focus group, selecting the right jurors, obtaining the most useful testimony, the best-qualified experts, and presenting its case as dynamically as possible using every available technology.
